Privacy Notice
I.- Ownership of the information: The use and protection of your personal information is the responsibility of GONHERMEX, SA DE CV, with address at Av. Manuel Ordóñez #610, Zona Centro, Santa Catarina, Nuevo León, México.
II.- Personal data collected and the purpose of the treatment: The user, at the moment in which he/she delivers his/her documentation, gives his/her consent so that GONHERMEX, SA DE CV as well as its affiliated companies, which are: ENERYA, SA DE CV; ENERYA, SA DE CV; GONHERMEX, SA DE CV; ENERYA, SA DE CV; ENERYA, SA DE CV: ENERYA, SA DE CV; QUÍMICA GONCAL, SA DE CV; AUTOTRANSPORTES JAG SA DE CV, LUBRICANTES DE AMÉRICA, SA DE CV and GONHER DE MÉXICO, SA DE CV, RECICLADORA INDUSTRIAL DE ACUMULADORES, SA DE CV, (all of them hereinafter referred to as Grupo Gonher), to use your information for the purposes set forth below: internal analysis of Grupo Gonher, in order to contact the persons who enter their personal data for possible job vacancies of Grupo Gonher, and/or clients and/or prospective clients that it has, as well as to send merchandise, correspondence, purchase orders, tax receipts and all the documentation or information related to the commercial and/or labor activity that it carries out with the one who enters the data. The fact that information is entered by this means, in no way is understood as an arrangement, communication, hiring, consideration for any specific position, nor does it generate any obligation for the Gonher Group or its affiliated companies, except for the legal dispositions regarding the protection of personal data.
III.-Security of the information: Your personal data provided will be protected with the same security procedures with which the Gonher Group’s own data are protected within its computer platforms and will only be used by the personnel authorized to do so, who have in force CONFIDENTIALITY agreements with the Gonher Group and with the owners of the personal information.
IV.- Mechanism to exercise their rights of access, rectification, cancellation or opposition of their personal data (ARCO): The Owners of the information will have the right to request the access, rectification, cancellation or opposition of their data, through a written request addressed generically to GONHERMEX, SA DE CV at the following address: Av. Manuel Ordóñez #610, Zona Centro, Santa Catarina, Nuevo León, México.
V.- Transfer of personal data: The information that the user enters will not be disclosed under any circumstances to third parties except with the authorization of the person who owns it, with the exception of the provisions of the National Laws and International Treaties in force and applicable.
VI.- Sensitive Information: It is understood as “sensitive information”, according to Article 3 Section VII of the Federal Law for the Protection of Personal Data in Possession of Individuals, the following: Racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions and sexual preferences. For the above mentioned, the Gonher Group will not create databases containing this kind of information.
The Gonher Group, will not request under any circumstance “sensitive information” to its Clients, therefore, they should abstain from entering it in the fields that are placed for such effect, any “sensitive information” that is entered to the database, will be eliminated by the Gonher Group.
It is the responsibility of the user to contravene this clause and the fact that by this means he/she reveals “sensitive information” does not generate any kind of obligation for the Gonher Group or its affiliated companies.

VII.- Modification of personal data: It is the responsibility of the Holder of the Personal Data to guarantee that the data provided to the Gonher Group are truthful and complete, and is responsible for communicating to the Gonher Group any modification in the same in order to comply with the obligation to keep the information updated.
VIII.- Temporality of personal data: The temporality of the handling of the Personal Data of the Holder, will depend on the legal relationship celebrated with the Gonher Group, as well as the obligations required by the current legislation and the competent authorities. In all cases the information will be kept only for the reasonable time for the fulfillment of the legal obligations.
IX.- Acceptance: With this Privacy Notice, the Owners of the information are duly informed of the data collected from them and for what purposes, accepting the terms contained herein, which were developed in compliance with the Federal Law on Protection of Personal Data Held by Private Parties.
X.- Changes to the Privacy Notice: The Gonher Group reserves the right to modify the present policy to adapt it to new legislation or jurisprudence, as well as to industry practices. In such cases, the changes will be announced on this page with reasonable notice before their implementation.
XI.-Legislation: The present Privacy Notice, as well as the handling in general of the personal information made by the Gonher Group, is governed by the legislation in force and applicable in the United Mexican States, any controversy that may arise due to its application must be ventilated before the competent courts of the city of Monterrey, Nuevo Leon, Mexico and by the Mexican legislation in force.
